Terms of Service

These Terms govern your use of VirginiaCourtFile Intelligence ("the Service"), a subscription product operated by CourtFile LLC, a Virginia limited liability company ("we", "us"). By creating an account or using the Service, you agree to these Terms.

1. The Service

VCF Intelligence aggregates public Virginia criminal court records into per-attorney decision-support views — charge × jurisdiction × year outcome statistics, sentencing benchmark comparisons, court-speed indicators, prosecutor and officer patterns. It is provided as a hosted web application at intel.virginiacourtfile.com.

The Service is aggregate statistics, not legal advice. It is a tool defense attorneys use to calibrate expectations and case-strategy choices. Every output we render carries a methodology disclosure. The Service is not a prediction of any individual case and is not a substitute for the professional judgment of an attorney admitted to practice in Virginia.

2. Account and eligibility

You must be at least 18 and authorized to enter binding agreements. The Service is sold to licensed Virginia criminal-defense attorneys and adjacent professionals (civil-rights litigators, academic researchers, defense firm staff). You are responsible for keeping your credentials confidential and for activity that occurs under your account. Notify us promptly of any suspected unauthorized use.

3. Subscription, trial, and billing

The Service is offered on a monthly subscription at $299 per seat per month, with a 14-day free trial for new accounts. Multi-seat and custom pricing are available on request. Billing is processed by Stripe; you authorize recurring charges to the payment method you provide.

You may cancel at any time. Cancellation takes effect at the end of the current billing period; you continue to have access until then. Trials canceled before the 14th day are not charged. We do not refund partial periods.

We may change pricing on at least 30 days' notice. Subscribers who signed up before a price change retain their existing price as long as their subscription remains active without lapse.

4. Methodology and no legal advice

All statistics are computed from public court records using documented methodology published at www.virginiacourtfile.com/methodology. Aggregates are time-windowed, denominator-disclosed, and past-tense only. We make no causal claims and no predictions about any individual case.

Nothing in the Service is legal advice. No attorney-client relationship is formed between you and CourtFile LLC by your use of the Service. Consult a licensed Virginia attorney for advice about any specific matter.

5. Officer Intelligence — usage restriction

Subscriber may not use Officer Intelligence data — including but not limited to officer × outcome rates, officer × judge patterns, officer × prosecutor patterns, or any individual officer's aggregated record — to harass, defame, or publicly republish information about any individual officer. Officer Intelligence is licensed for internal case-strategy and litigation use only.

Permissible uses include: cross-examination preparation, motion practice (e.g., Brady / Giglio considerations), internal case assessment, and confidential discussion with your client or co-counsel. Impermissible uses include: social-media posts about individual officers, news media republication, public databases or directories of officers, and any communication designed to intimidate.

Violation of this provision is a material breach. We may suspend or terminate access immediately and without refund if we have reasonable grounds to believe a subscriber has breached this clause.

6. Acceptable use

You agree not to:

  • Scrape, automate, or systematically download data from the Service except as expressly permitted by your subscription.
  • Share your seat with anyone outside the account holder's firm. Each seat is for one named attorney or staff member.
  • Reverse-engineer the Service or its methodology beyond what is publicly disclosed.
  • Use the Service to violate any applicable law, court rule, or rule of professional conduct.
  • Republish, resell, or commercially redistribute the Service's output without our written permission.

7. Intellectual property

The Service's methodology, aggregations, code, design system, and user interface are our intellectual property or licensed to us. We grant you a non-exclusive, non-transferable, revocable license to access and use the Service for the duration of your subscription.

Underlying public court records remain in the public domain. We do not claim ownership of the raw facts; we claim ownership of the methodology, the aggregation, the editorial presentation, and the software.

8. Confidentiality

Notes you write inside the Service are scoped to your account and are not shared with other subscribers. We may access notes only as necessary to operate the Service or respond to lawful legal process. You should not put attorney-client privileged content or client identifying information in notes; the Service is not designed as a client-file system.

9. Termination

You may terminate by canceling your subscription at any time. We may terminate or suspend your access immediately if you breach these Terms, abuse the Service, or fail to pay. On termination, your right to use the Service ends; account data is retained or deleted per our Privacy Policy.

10. Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE." We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. Court data may contain errors, gaps, or delays inherited from source records. You are responsible for verifying any output against authoritative sources before relying on it in court.

11. Limitation of liability

To the maximum extent permitted by law, CourtFile LLC and its officers, employees, and agents are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Service. Our aggregate liability for any claim arising out of or related to these Terms or the Service is limited to the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless CourtFile LLC from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.

13. Governing law and venue

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Virginia Beach, Virginia, and you consent to personal jurisdiction and venue there.

14. Changes to these Terms

Material changes to these Terms will be announced by email to active subscribers at least 14 days before they take effect. Continued use of the Service after the effective date is your acceptance. If you disagree with material changes, you may cancel before they take effect.
